{"id":3214,"date":"2017-12-01T08:00:46","date_gmt":"2017-12-01T13:00:46","guid":{"rendered":"https:\/\/lmrlawyers.com\/?p=3214\/"},"modified":"2018-04-02T13:31:06","modified_gmt":"2018-04-02T17:31:06","slug":"can-non-parent-awarded-access","status":"publish","type":"post","link":"https:\/\/lmrlawyers.com\/fr\/can-non-parent-awarded-access\/","title":{"rendered":"When Can a Non-Parent Be Awarded Access?"},"content":{"rendered":"<p>In a recently released <a href=\"http:\/\/canlii.ca\/t\/h6fbh\" target=\"_blank\" rel=\"noopener\">decision<\/a> of our local judge, Justice Robert Beaudoin, the Court refused to grant an Order allowing a former partner to maintain a relationship with the two-and-a-half-year-old son of his former girlfriend.\u00a0 After considering all of the evidence before him, Justice Beaudoin determined that the Applicant\u2019s continued involvement with the little boy would not be in the child\u2019s best interests and his request for access was dismissed.<\/p>\n<p>Under the <em>Children\u2019s Law Reform Act <\/em>the ability to claim custody or access to a child is not limited to the biological parents of the child.\u00a0 <strong><em>Any person<\/em><\/strong> can make an application to the Court for an Order respecting custody of or access to a child.\u00a0 When making an application for custody for a child, the non-parent must complete an Application, a detailed Affidavit in support of the claim, submit a police record check and sign a form authorizing Children\u2019s Aid Societies to provide information from their records relating to the Applicant.\u00a0 In addressing the claim, the Court must determine the issue on the basis of what is in the best interests of the child.\u00a0 Consideration must be given to all of the child\u2019s needs and circumstances including the emotional ties between the child and the Applicant, as well as the child\u2019s bonds to other members of his\/her family. Consideration must be given by the Court to a myriad of considerations identified in the legislation, including the plan proposed by the person bringing the Application, the abilities of such person to act as a parent and the stability of the family unit, see the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90c12#BK40\" target=\"_blank\" rel=\"noopener\"><em>Children\u2019s Law Reform Act<\/em>, s. 24<\/a>.<\/p>\n<p>In the <a href=\"http:\/\/canlii.ca\/t\/h6fbh\" target=\"_blank\" rel=\"noopener\"><em>Geisler<\/em> v. <em>Georgeoff<\/em><\/a> case, the Applicant had lived with the child\u2019s mother for a period of approximately six months.\u00a0 Following separation, the Applicant saw the little boy one week per month which later evolved to five days per month.\u00a0 After approximately one year, when the child was 20 months old, the mother terminated the Applicant\u2019s access which then triggered the Application.\u00a0 In reaching his decision, Justice Beaudoin gave consideration to the fact that the mother was now involved in a new relationship and had a second child with her new partner.\u00a0 The little boy considered the mother\u2019s new partner as his father, and he was very closely bonded to his new baby brother.\u00a0 Although the Applicant\u2019s evidence demonstrated his sincere interest in maintaining a relationship with the child, Justice Beaudoin found that there was no compelling evidence to demonstrate that a continued relationship between the little boy and the Applicant was in the best interests of the child.<\/p>\n<p>Cases involving custody and access can be very emotionally charged.\u00a0 Litigants feel strongly about their relationship with the child and often want desperately to maintain that relationship post-separation.\u00a0 But such cases are not about the parties\u2019 wishes; rather about the best interests of the child.\u00a0 Without compelling evidence to demonstrate that a continued relationship is best for the child, a non-parent\u2019s claim for access will fail.<\/p>\n<p>If you would like more information about custody and access issues, feel free to <a href=\"https:\/\/lmrlawyers.com\/\">contact a member of LMR\u2019s Family Law Group.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a recently released decision of our local judge, Justice Robert Beaudoin, the Court refused to grant an Order allowing a former partner to maintain a relationship with the two-and-a-half-year-old &hellip; <\/p>\n<p><a class=\"button\" href=\"https:\/\/lmrlawyers.com\/fr\/can-non-parent-awarded-access\/\">Continuer la lecture<\/a><\/p>\n","protected":false},"author":5,"featured_media":3215,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[24],"tags":[],"class_list":["post-3214","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-family-law"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>When Can a Non-Parent Be Awarded Access?
